Rockmart Police Department (RPD) reports state that someone in the Arbour Chase neighborhood called 911 around 5:25 a.m. Feb. 24 with a report of shots fired.
Officers traced the incident to 207 Arbour Chase Drive, where neighbors heard loud music and several gunshots.
Police found several males sitting in the residence, beer cans throughout the room and a strong odor of alcohol on a male’s breath while he talked to the officers, according to reports.
The man, later identified as Rafael Gonzalez, 29, who resides at the home, told police the group had gotten home from a club and no shots had been fired.
An officer found a 9mm shell casing outside the front door, reports state. Officers continued looking and found four others on the walk near the front door.
Gonzalez said friends were showing off a gun and he kicked them out.
While Gonzalez told officers there were no guns in the house, police saw a live 9mm round in open view on a coffee table beside the front door, reports said.
All the men were then detained and police searched the the home.
Officers found a 9mm Beretta under a chair.
Reports state all of the men were arrested because no one claimed the gun, none admitted to firing the shots, all were under the influence of alcohol and had attempted to deceive officers to avoid arrest.
Rafael Gonzalez; Johnny Bineda Gonzalez, 24, and Christian Gonzalez, 26, both of 591 Michael Blvd., Cedartown; Marvin Escutia, 21, of 129 Central St., Cedartown; and Sergio Nunez, 20, of 517 Pine St., Cedartown, were all charged with obstructing or hindering law enforcement officers, discharge of firearms on or near public highway or right-of-way and reckless conduct.
All were taken to the Polk County Jail. All have since been released on bond.
