States ask fed court to overturn health overhaul

ATLANTA -- The states challenging the overhaul of the health care system filed a brief urging a federal appeals court to strike down the law.

The filing by 26 of the 50 states on Wednesday asked the 11th Circuit Court of Appeals in Atlanta to uphold a judge's ruling that found the changes to the health care system were unconstitutional. It said the law pushes the "federal government's constitutional powers past the breaking point."

The Justice Department asked the court to review the ruling in April, saying that Congress had the clear authority to adopt the new health care rules.

The legal showdown was set up in January when U.S. District Judge Roger Vinson ruled that Congress exceeded its authority by requiring nearly all Americans to carry health insurance.

This requirement has been my biggest objection to Obamacare. The opinion of most legislators was that most Americans without healthcare do not have it by choice. That is WRONG! Most have no health insurance simply because they cannot afford the premiums. Many years ago I found myself in the same situation. The ONLY choice I had at the time was between paying for health insurance or buying groceries. A combination of low wages and extremely high premiums put health insurance totally out of reach at that time. For me to have been fined for failure to carry that insurance would be the ultimate injustice. While I agree that our healthcare system needs to be completely overhauled this provision was an extremely bad idea. You can't beat the American people into subjection. Strike down this piece of garbage and make Congress start over.
